General Terms & Conditions

I. General

These general terms and conditions (hereafter referred to as ‘T&Cs’) apply to the electronic ordering of all forms of tickets for Just Product events. Just Product is a series of events organized by Product Masterclass GmbH, Pariserstraße 14, 81669 Munich (hereinafter referred to as ‘Just Product’ or ‘the organiser’).

Just Product has appointed Eventbrite Operations (IE) Ltd, Unit 3100, Citywest Business Campus Dublin 24, Citywest, Dublin, D24AK82, Irland (www.eventbrite.com) as service provider for the ticket process of Just Product. Eventbrite enables the registration for, and payment of, tickets for Just Product.

By ordering tickets for Just Product, the customer accepts these T&Cs. Any other terms and conditions have no validity.

II. Conclusion of contract

Just product is an event for the best in product.

Tickets can be ordered via a link on our website (www.justproduct.de - incl. sub pages) which leads the user to Eventbrite (eventbrite.com), the Just Product online ticket tool. The contract regarding the sale of ticket(s) becomes binding when the user clicks “Place order” in the ticket tool. The ticket fee and statutory value- added tax are shown on left side of the screen showing the “Place order” button.

Afterwards, Just Product will send an email to the address provided by the customer as part of the order. The email contains a confirmation of the order, a link to the order receipt as well as instructions on how to view the order.

The customer is free to change his contact and tax details at any time via the link in his or her ticket email. The customer will not receive any additional ticket/s by post.

2. Admission regulations

Customers are obliged to check received tickets for errors regarding price, date, event and venue. The customer shall be solely responsible for safeguarding the tickets and for bringing them with him or her to the event.

Tickets can only be purchased for personal use. Purchase for profitable repurchase (commercial use) is prohibited.

Customers can provide a hard copy. The validity of the ticket is guaranteed by a printed barcode, which is checked at the entrance by means of a barcode scanner. A multiple access to the event by duplicated tickets is thus excluded.

Alternatively, the tickets can be saved as a digital version on a mobile device with the appropriate iOS / Android app. In this case, the barcode will be scanned and checked at the entrance point.

In exchange for the ticket the customer will receive a badge enabling entry to the Just Product event for which they booked. In the case of lost tickets or badges, no claims for a refund of the attendance fee, or for a replacement ticket or badge, will be entertained. The reproduction of tickets is not permitted. The customer is obliged to hold on to tickets in such a way as to prevent any misuse. The customer will be held responsible for misuse of the tickets. Tickets are to be presented at registration upon entering the venue.

3. Terms of payment and due date

The Customer can pay by credit card, Paypal, direct debit (processed via Eventbrite) or invoice (for group discounts and upon special request).

In the event of late payment or chargeback by credit card, Paypal or direct debit Just Product reserves the right, but does not undertake, to withdraw from the contract or refuse participation in Just Product events until the outstanding amount has been paid.

4. Rights of withdrawal for consumers (pursuant to § 13 German Civil Code – BGB)

Participants whose registration can predominantly neither be attributed to their commercial nor their independent professional activity are consumers within the meaning of § 13 BGB.

According to § 312 para. 2 S. 1 lit. g) BGB, Just Product is the provision of a service in connection with a leisure activity, since a specific period is provided for the fulfilment of the contract. As a result, the participant has no right of withdrawal with regard to the purchase of a Just Product ticket.

5. Refunds / No-shows

Refunds of attendance fees will not be entertained in the case of no-shows.

However the customer is free to transfer his or her ticket to another person named by him or her at any time before Just Product starts. This can be done in Eventbrite via links shared in the ticket email. Just Product will not check or make sure that tickets are only transferred to persons within the ticket buyer’s organization.

Just Product reserves the right to change speakers and topics. Changes to topics, speakers or venues are also no sufficient reason to withdraw from the ticket purchase.

6. Photographs and recordings

The customer hereby expressly confirms his agreement that the organiser shall have the right to take photographs or make recordings of the customer before and during the entire event, and to publish, disseminate and circulate the same on the Internet, in print media and other media.

The commercial use of own photographs and footage taken at the venues of Just Product requires agreement by the organiser.

7. Postponement or cancellation

Just Product reserves the right to cancel or postpone the event.

In the case of cancellation of Just Product events, customers who have already bought tickets will be notified via email and the entrance fee will be refunded.

In the case of postponement of Just Product events, Just Product will contact customers who have purchased tickets via the email given when purchasing the tickets. In such cases the customer may choose to attend the events on the rescheduled date or to receive a refund of the attendance fee.

The customer must advise Just Product of his or her decision within 14 days of receipt of the information regarding the postponement. Otherwise, he or she has no claim to a refund of the ticket fee.

8. Liability

Just Product will be liable without limitation according to the German Product Liability Act (Produkthaftungsgesetz), for damages caused intentionally or through gross negligence, for fraudulent concealment of defects, as well as for damages resulting from injury to life, body or health. The liability for damages resulting from the violation of a guarantee is also unlimited.

In the event of a breach of essential contractual obligations (so-called cardinal obligations) based only on simple negligence, Just Product’s liability shall be limited to compensation for the foreseeable, contract-typical damage. Just Product shall not be liable for damages caused by simple negligence, except for the cases mentioned in paragraphs 1 and 2.

The right of the customer to withdraw from the contract due to a breach of duty for which Just Product is not responsible and which does not result from a defect in the goods is excluded.

Insofar as the liability of Just Product is excluded or limited according to the preceding paragraphs, this shall also apply to the liability of its agents and vicarious agents.

9. Lost & Found

In the event of having lost an item visitors can contact Just Product via email to justproduct@product-masterclass.com with an exact description of the item.

10. Force Majeure

The organiser shall not be liable for any failure or delay in performing its obligations under the ticket contract where such failure or delay results from circumstances beyond its reasonable control. Such circumstances include, without limitation, epidemics or pandemics, orders, regulations, or recommendations of public authorities, war, terrorism, or threats thereof, civil unrest, strikes affecting public transport, airlines, or the venue, loss or unavailability of the venue, fire, flood, or other natural events, failure of essential utilities at the venue, and significant disruption to information or communication infrastructure.

In the event of force majeure, the organiser may, at its discretion, postpone the event, convert the event in whole or in part to an online format, relocate the event, or cancel the event. Where the event is cancelled in full, customers shall receive a refund of the ticket fee. Where the event is postponed, relocated, or converted to an online format, the rules of clause 7 (Postponement or cancellation) shall apply. The organiser shall not be liable for any further damages, including travel costs, accommodation costs, lost working time, or consequential losses.

11. Code of Conduct and Right to Refuse Entry

All attendees, speakers, sponsors, and staff are expected to behave respectfully toward one another. Harassment, discrimination, threatening or abusive behaviour, and any conduct that disrupts the event or endangers other participants is not tolerated. The organiser reserves the right to refuse entry, to remove an attendee from the event, and to ban an attendee from future events without refund where such conduct occurs. Decisions of the organiser in this respect are final.

12. Travel and Accommodation

The customer is responsible for arranging and paying for their own travel, accommodation, visa, insurance, and any other costs associated with attending the event. In the event of cancellation, postponement, relocation, change of speakers or topics, or any other change to the event, the organiser shall reimburse only the ticket fee in accordance with these terms and shall not be liable for any travel, accommodation, or related costs incurred by the customer.

13. Personal Property

The organiser shall not be liable for the loss of, theft of, or damage to personal property brought by attendees to the event venue, including but not limited to laptops, mobile devices, clothing, and bags. Attendees are responsible for safeguarding their own belongings. This clause does not affect the organiser’s liability for damages caused intentionally or by gross negligence, nor for personal injury.

14. Health and Personal Risk

Attendance at the event is at the customer’s own risk in respect of exposure to communicable illness and minor incidents on the venue premises, within the limits set by mandatory German law. Customers with relevant medical conditions, food allergies, or dietary requirements are responsible for declaring these in advance via justproduct@product-masterclass.com. The organiser will use reasonable efforts to accommodate declared requirements but does not guarantee that all such requirements can be met.

15. Workshop Minimum Attendance

Workshops are subject to a minimum number of registered participants, as indicated on the relevant workshop page. Where the minimum is not reached by a date determined by the organiser, the organiser may cancel the workshop. In such case, the customer shall receive a full refund of the workshop fee. The organiser shall not be liable for any further costs, including travel and accommodation.

16. Sharing of Participant Information with Venue Hosts

Where the customer registers for a workshop, the organiser will share the customer’s name, email address, ticket type, and registration status with the venue host (the organisation providing the workshop venue). This sharing is necessary (a) for accounting purposes, including the calculation and settlement of any revenue share or cost split between the organiser and the venue host, and (b) for the venue host to manage onsite access and security, prepare catering and materials, and confirm who is present at their location. The legal basis for this processing is the performance of the ticket contract (Art. 6(1)(b) GDPR) together with the legitimate interests of the organiser and the venue host (Art. 6(1)(f) GDPR). Venue hosts are required to use the data only for the purposes set out above and to comply with applicable data protection law.

17. Third Party Content

Talks, workshops, and other contributions delivered at the event represent the views and experience of the respective speakers. They do not constitute advice from the organiser, nor an endorsement by the organiser of any product, service, or method discussed. The customer is solely responsible for any decisions made on the basis of event content. The organiser gives no warranty of accuracy, completeness, or fitness for any particular purpose in respect of event content.

18. Sponsors and Exhibitors

Interactions between attendees and sponsors or exhibitors at the event, including any contracts entered into and any product representations made, are the sole responsibility of the parties involved. The organiser is not a party to such interactions and is not liable for the conduct of sponsors or exhibitors, the accuracy of their representations, or the performance of their products or services.

19. Visa and Entry

Where the customer requires a visa or other authorisation to enter Germany or the European Union for the purpose of attending the event, the customer is solely responsible for obtaining such authorisation in good time. Failure to obtain a visa or refusal of entry does not entitle the customer to a refund. On reasonable request, the organiser will provide a confirmation of registration to support a visa application.

20. Applicable law and place of jurisdiction

Applicable Law is German.

The place of fulfilment and court of jurisdiction, to the extent that this is permitted by law, is Munich, Germany.

21. Concluding Provisions

Should one or more provisions of these T&Cs prove invalid or contain loopholes, this does not affect the validity of the remaining terms and conditions. The parties will replace or extend the invalid or incomplete provision with an appropriate provision which comes closest to its commercial purpose.

22. Right of Modification

Furthermore, Just Product reserves the right to amend these GTC to improve and/or clarify the service provisions or due to changed legal provisions.
